Terms of Service

These Terms of Service ("Terms") govern your access to and use of Mailto.Bot (the "Service"), operated by Happy Cactus AI. By creating an account or using the Service, you agree to these Terms. If you don't agree, don't use the Service.

1. Service Description

Mailto.Bot is an email API designed for developers and AI agents. It provides:

  • Programmable inbound mailboxes at @mailto.bot addresses.
  • Real-time webhook delivery of inbound messages to your endpoints.
  • REST API and Model Context Protocol (MCP) server for reading and managing messages.
  • A developer dashboard for managing mailboxes, API tokens, and billing.

The Service is intended for developers integrating email functionality into applications and AI workflows. It is not a general-purpose email client or marketing platform.

2. Account Responsibilities

You are responsible for:

  • Providing accurate and complete registration information.
  • Keeping your password and API tokens confidential. Do not share API keys in public repositories, client-side code, or with unauthorised parties.
  • All activity that occurs under your account, whether or not you authorised it.
  • Notifying us immediately at mailtobot@happycactus.ai if you suspect unauthorised access to your account.

One person or legal entity may not maintain more than one free account. If we discover duplicate free accounts, we may merge or terminate the extras.

3. Acceptable Use

You may use Mailto.Bot only for lawful purposes and in accordance with these Terms. You must not use the Service to:

  • Send or facilitate spam, phishing, or unsolicited bulk email.
  • Distribute malware, viruses, or other harmful code.
  • Harvest email addresses or engage in scraping that violates third-party terms.
  • Transmit illegal content or content that violates others' intellectual property rights.
  • Circumvent plan limits by creating multiple free accounts or abusing trial periods.
  • Resell or sublicense access to the Service without our written consent.
  • Attempt to gain unauthorised access to our systems, networks, or other users' data.

Violation of this section is grounds for immediate account suspension without refund.

4. Plan Limits

Current plan limits, features, and pricing are listed on our Pricing page. Limits reset at the start of each calendar month.

5. Billing

  • Payment processorAll payments are handled by Stripe. By subscribing, you agree to Stripe's terms of service. We never see or store your full card number.
  • Billing cycleSubscriptions are billed monthly on the anniversary of your upgrade date.
  • ProrationUpgrading mid-cycle prorates the charge for the remaining days. Downgrading takes effect at the end of the current billing period.
  • CancellationYou may cancel at any time from Settings → Billing. Your plan reverts to Free at the end of the current billing period. No refunds are issued for partial months.
  • Failed paymentsIf a payment fails, we retry 3 times over 7 days. After that, your account reverts to the Free plan.

6. Changes to Plans & Pricing

We reserve the right to modify, replace, restructure, or discontinue any subscription plan, including changes to pricing, included features, and usage limits.

For material changes (price increases, feature removals, or limit reductions to your active plan), we will notify you by email at least 7 days in advance of the effective date.

No refunds are issued for partial billing periods, but you will retain access to your current plan through the end of your current billing cycle.

Continued use of the Service after the effective date constitutes acceptance of the updated plan terms. If you do not agree, you may cancel before the effective date.

New plans, optional add-ons, and promotional pricing may be introduced at any time without notice.

7. Uptime

We run Mailto.Bot on Google Cloud and aim for high availability, but we are currently in an early phase of the product.

No SLA is guaranteed at this time.We do not offer uptime commitments, credits for downtime, or contractual service level agreements. We'll add these when the product reaches general availability.

We perform maintenance with best-effort advance notice. Critical security patches may be applied without advance notice.

8. Termination

You may delete your account at any time from Settings → Delete Account. Deletion removes all your data within 30 days.

Wemay suspend or terminate your account immediately, without notice, if we determine you have violated the Acceptable Use policy (Section 3) or any applicable law. In less serious cases, we'll warn you first and give you a reasonable period to remedy the issue.

Upon termination, your right to access the Service ends immediately. Sections on Limitation of Liability and Acceptable Use survive termination.

9. Limitation of Liability

Please read this section carefully — it limits our liability to you.

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, HAPPY CACTUS AI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING UNDER THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR $100 USD, WHICHEVER IS GREATER.

10. Changes to These Terms

We may update these Terms from time to time. For material changes we will:

  • Email all registered users at least 30 days before the changes take effect.
  • Update the "Last updated" date at the top of this page.
  • Post a notice in the dashboard.

Continuing to use the Service after changes take effect constitutes acceptance of the revised Terms. If you disagree with changes, you may delete your account before they take effect.
